Marriage registration certificate is a certificate that shows the relationship of two people as husband and wife and that they are married and it has become very important in today’s time that there should be a legal document to identify a relationship so that the married parties do not face any difficulty and can exercise their rights as married, for this, there is a great need for a marriage registration certificate in today’s time and how can it be made

Any marriage certificate can be obtained by applying in two ways, in which

  1. Hindu Marriage Act 1955
  2. Special Marriage Act 1954

Under the Hindu Marriage Act, both the parties should be unmarried or if any of the parties is already married, then he/she should be divorced. For marriage, the parties should be free from the bond of their first marriage so that they can marry the person of their choice.

Hindu Marriage Act is applicable only for the Hindu community, except Special Marriage Act 1954, which applies equally to all citizens and they are free to marry a person of any caste.

  1. Residential certificate of both husband and wife which includes voter card, Aadhaar card, ration card, passport, driving license
  2. 2 photos of both of them, one of which is their wedding photo and the other is their wedding card
  3. The application form must be completely filled and signed by both the parents of the husband and wife
  4. Non judicial stamp paper of Rs.10 along with separate affidavits of both
  5. Certificate issued by the purohit / priest of the temple where the marriage took place
  6. Birth certificate of both the persons in which the age of the male person should be 21 years and the age of the female person should be above 18 years
  7. If the marriage is being done with a foreigner then a No Objection Certificate has to be obtained from the embassy of that country
  8. All documents have to be self-attested and then attested by a gazette officer

 

How can marriage registration be done

  1. Husband and wife can apply for marriage registration in the office of SDM sub divisional magistrate of their area.
  2. The application form must have photographs and signatures of both the husband and wife
  3. The documents attached with the application form are checked and then a date is fixed through notification on which both the candidates can go to the registrar’s office and get the registration done.
  4. Application for registration can be made within 30 days of marriage and it can be made by the registrar for a period of five years. If the period is longer than this, it can be made by the district magistrate at a discount.
  5. Under the Special Marriage Act 1954, this application has to be given 30 days before the marriage and at the time of registration, the presence of parents and witnesses of both the parties is mandatory.

In divorce cases: Marriage certificate is also useful in getting a divorce. When the divorce appeal is filed, the certificate can be attached with the appeal. The divorced woman has to show the divorce documents for government work as well. Marriage certificate is also required to get maintenance allowance at the time of divorce.

In cases of fraud: If any kind of fraud is committed by either of the parties after marriage with the help of marriage certificate, then the police can investigate at the address given in the documents attached with the certificate and the other party can be caught by implicating them.
