Self Defense Right to self defense
Every person has been given the right of self-defense by law so that the person can face the situation when the time comes and can fight to save his family members including his wife, his children, parents, relatives and his property.
The right to self-defense includes the right to defend oneself and the amount of harm that one should inflict on another is considered to be as much as is necessary for the person’s self-defense.
If criminals enter a person’s house with the intention of theft or robbery and the life of the house owner and family members is in danger, then the owner can use any object to protect himself and his family, which may include a stick. If the thieves have any kind of weapon like a knife or pistol, then the person can also use any weapon in his defense, which includes a knife, gun to scare and if a thief dies due to a gunshot, then the person has to prove that the thieves also had guns and he fired in defense of himself and his family.
Self-defense is explained in sections 96 to 106 of the IPC
Section 96 talks about self-defense
In section 97, a person has the right to protect his body and property. If a person causes any kind of injury to his body or property, then the person has the full right to take retaliatory action.
Under Section 99, only that much damage can be caused to a criminal which is sufficient for self-defense. If self-defense can be done by using sticks, then that much self-defense is sufficient and not by using a gun or weapon.
According to section 100, if a person dies in a criminal incident which includes cognizable offences like shooting a person, committing misconduct, rape, kidnapping etc., then section 100 can be used but the person has to prove that he fired the bullet to scare the criminals and in self-defence. Self Defence is the right to self-defence.
Other people/mob attack on criminals
It is often seen that in the street or locality, for some crime like molestation, snatching, etc., the people of the locality and the crowd beat up the criminal badly, but legally speaking, the crowd should not beat up the criminal, rather the criminal should be caught and handed over to the police. Under Section 43, if the crowd catches a criminal before he commits a crime and hands him over to the police, then he can be punished by law. Self Defense (Right to Self Defense)
